After-Hours and Off-Site Sexual Harassment: When Work Follows You Out the Door

A common misconception is that sexual harassment only counts if it happens at your desk during business hours. Employers sometimes encourage that belief, telling employees that what happened at the party or on the trip is a personal matter.

The law asks a different question.

The Real Test: Was It Connected to Work?

Location and clock time are not the boundary. What matters is the connection between the conduct and your employment. Factors that establish that connection include:

The event was organised, sponsored, encouraged, or paid for by the employer
Attendance was expected, even if it was described as optional
The people involved were colleagues, supervisors, clients, or vendors
The harasser held workplace power over you
The conduct affected your working conditions afterwards
The event served a business purpose, such as networking or client development

Where It Most Commonly Happens

Company parties and celebrations

Holiday parties, team dinners, and awards nights, particularly where alcohol is served, are among the most frequent settings for workplace harassment complaints.

Conferences and industry events

Where attendance is part of the job, misconduct at the conference, the hotel bar, or the after-party can be work-related.

Business travel

Shared travel, hotel stays, dinners, and rideshares compress professional boundaries. Pressure to continue a meeting in a hotel room is a recurring pattern in these cases.

Client entertainment

Where an employee is expected to socialise with clients to develop business, harassment by that client can still implicate the employer.

Messages sent after hours

Texts and direct messages that begin about scheduling and turn personal or sexual are work-related conduct, even though they arrive on a personal phone at midnight.

Alcohol Does Not Change the Analysis

Employers occasionally suggest that drinking excuses the behaviour or shifts responsibility to the person harmed. It does neither. Where an employer serves alcohol at a work event, the foreseeable consequences of doing so form part of the context in which its duty is assessed.

Evidence in Off-Site Cases

These cases are often better documented than office incidents, because so much of the surrounding activity leaves a digital trail.

Texts and direct messages before and after the incident
Calendar invitations, itineraries, and conference registrations
Hotel and rideshare receipts with timestamps
Photographs from the event establishing who was present
Witnesses, including anyone who saw you leave or noticed your reaction
A contemporaneous note recording what happened and when

If You Did Not Report Straight Away

Delayed reporting is extremely common in off-site cases, often because the setting was social and the person was unsure whether it counted. That delay is explainable and does not by itself defeat a claim. What matters is building a clear record from the point you are able to.

Conclusion

An employer cannot extend the workplace to a hotel, a conference floor, or a client dinner for business purposes and then disclaim responsibility for what happens there. If the conduct was connected to your job, or if your working life changed afterwards, you may have a claim.
