New Jersey's Seven-Year Window & When It Starts

You may have been told that New Jersey gives you seven years, counted the day it happened, and that your seven years are gone. If that is why you stopped looking into this, it is worth looking again. New Jersey does give adult survivors of sexual assault seven years. What it does not do is start counting on the date of the assault. The period runs from the point at which you reasonably discovered your injury and its connection to what was done to you, which is a different date and is sometimes a much later one. That distinction is not a technicality. It is the heart of most New Jersey cases, and it is the reason survivors who assumed they were decades too late are sometimes not too late at all. This post explains what has to be discovered before the clock starts, why remembering an assault is not the same as discovering the claim, and how the question actually gets decided. Seven years, but seven years from when

New Jersey changed its law in 2019. Adult survivors of sexual assault previously had two years, measured in the ordinary way, which closed most cases before survivors were anywhere near ready to bring them. The period is now seven years, and it applies to conduct that occurred before as well as after the change.

The more important part is the starting point. The seven years run from reasonable discovery rather than from the assault. Until that point is reached, the period has not begun. A survivor assaulted many years ago may therefore still be inside it, and a survivor assaulted recently is not automatically outside it either.

This is why New Jersey cases so often turn on a date that has to be established rather than a date anyone can look up.

The two things that have to be discovered

The test has two parts, and both have to be satisfied before the clock starts.

The first is the injury. You have to have discovered that you were harmed. That sounds obvious until you consider what the harm in these cases usually looks like: anxiety, depression, difficulty with intimacy or trust, disrupted sleep, substance use, an inability to hold work or relationships together. Survivors frequently live with all of that for years while understanding it as who they are rather than as an injury done to them.

The second is the connection. You have to have discovered that the harm is causally related to the assault. This is the part people miss. Knowing you were hurt is not the same as knowing why, and a survivor can be entirely aware of both the assault and the difficulties in their life without having joined the two together.

Both prongs are required. Discovering one without the other does not start the period running.

Why remembering is not the same as discovering

The single most common misunderstanding in this area is the assumption that a conscious memory of the assault must mean the clock started at the time.

New Jersey does not take that view. A survivor may remember an assault clearly, in detail, for years, and still not have reasonably discovered that their psychological injuries were caused by it. Memory is not the test. Understanding the causal connection is. That is why you do not need to have repressed anything, or to describe anything as recovered memory, for the discovery rule to matter to you.

In practice the moment of discovery often arrives through something ordinary. A course of therapy that names what happened. A diagnosis. Reading about someone else's experience. Learning that other people were harmed by the same person. A relationship or a job that finally breaks, and a professional who explains why. Any of these can be the point at which the connection becomes clear, and that point may sit years or decades after the assault.

How the question actually gets decided

Discovery is decided by a judge rather than a jury, and where the facts about when you discovered the connection are genuinely in dispute, that is usually resolved at a separate hearing before the case proceeds.

At that hearing the survivor carries the burden. A court weighs the circumstances as a whole, which can include the nature of the injury, what evidence is still available, how much time has passed, whether any delay was deliberate, and whether the other side is genuinely prejudiced by it. It is an equitable inquiry, which means the court is asking what is fair rather than applying a formula.

Two practical consequences follow. Records matter, because therapy notes, medical records and the timing of a diagnosis are often what establish when the connection was made. And your own account matters, so it is worth telling a lawyer honestly when you understood what had been done to you, even where that is uncomfortable or hard to date.

What else can affect the time available

Discovery is the main question, but it is not the only one.

New Jersey law also preserves the possibility of additional time on equitable grounds, including where a survivor's mental state, a disability, or pressure applied by the person responsible prevented them from bringing a case. Those arguments are fact-specific and are decided by the court rather than assumed.

You may also have read about the two-year window New Jersey opened for previously expired claims. That window ran from December 2019 to the end of November 2021 and is closed. Cases filed inside it continue, but it is not available for new claims, and anyone whose claim was revived only by that window is now back to the discovery analysis described above.

If you think you are already too late

A great many people who assume their claim expired have not had the discovery question properly considered, because the assumption seems so reasonable. The assault has a date. Everyone knows what a deadline is. It follows that the deadline passed.

In New Jersey that reasoning skips the step that matters. Before you conclude anything, it is worth a conversation in which someone asks you when you came to understand the connection between what happened and what it has cost you. That conversation is free and it commits you to nothing.

Frequently asked questions

I have remembered the assault the whole time. Does that mean my seven years started then?

Not necessarily. Conscious memory alone does not start the period under New Jersey law. What matters is when you reasonably discovered both the injury and its causal connection to the assault, and a survivor can remember an assault for years without having made that connection.

What if I cannot identify a single moment when I understood?

That is common and it is workable. Understanding often arrives gradually rather than in one moment. Courts consider the circumstances as a whole, and surrounding records frequently help place the period more precisely than memory alone.

Do I need to have been in therapy for this to apply?

No. Therapy records are often useful evidence, but they are not a requirement. The question is when you reasonably discovered the injury and its cause, which can happen through many routes.

The assault happened outside New Jersey but I live here now. Does this apply?

It depends, and it is worth asking rather than assuming. Which state's rules govern turns on where the conduct occurred and other connecting factors, and the answer can differ from where you live now.
