Co-Worker Sexual Harassment: When Is Your Employer Legally Responsible?

Not every harasser is a boss. A great deal of workplace sexual harassment comes from peers, and the legal analysis in those cases is different in one decisive respect: the employer is not automatically responsible for what a co-worker does. It becomes responsible for what it does once it finds out.

The Negligence Standard

Where the harasser is a co-worker, an employer is liable if it knew or should have known about the harassment and failed to take prompt and effective corrective action.

Both halves matter. An employer that never learns of the conduct and had no reason to may escape liability. An employer that learns of it and responds inadequately does not, no matter how good its written policy looks.

What Counts as Notice

Notice does not require a formal complaint on the right form to the right person. It can be actual or constructive, and courts have found it in all of the following:

A complaint to HR, a manager, or any supervisor
Earlier complaints about the same person from other employees
Conduct that was open and obvious enough that management should have seen it
Anonymous reports through a hotline
A pattern documented in personnel files that no one acted on

Prior complaints about the same co-worker are especially damaging to an employer, because they establish that the risk was known and tolerated.

What an Adequate Response Looks Like

Once on notice, an employer must act promptly, investigate impartially, and take corrective action reasonably calculated to stop the conduct. In practice that can mean separating the parties without penalising the complainant, issuing discipline, or terminating the harasser where the conduct warrants it.

Responses that routinely fail the standard include:

Doing nothing while promising to look into it
Moving the complainant to a different shift, team, or location
Treating it as a personality clash or a private dispute between two adults
Concluding an investigation without interviewing obvious witnesses
Warning the harasser informally and leaving no record

Note the second one in particular. Relocating the person who reported, rather than the person who harassed, is one of the most common employer mistakes and frequently supports a retaliation claim on its own.

Negligent Hiring, Retention, and Supervision

Beyond discrimination law, an employer may face tort claims for negligent hiring, retention, or supervision where it hired or kept an employee it knew or should have known posed a risk. These claims are separate from the harassment claim and can broaden the available recovery.

Claims Against the Co-Worker Personally

A co-worker who touched you without consent committed a battery. That claim belongs to you and can be brought against the individual regardless of whether the employer is ultimately held liable. Under the New Jersey Law Against Discrimination, a co-worker may also face individual liability for aiding and abetting discriminatory conduct.

The New York Difference

Amendments to the New York State Human Rights Law lowered the harassment threshold to conduct rising above petty slights and trivial inconveniences, and extended coverage to employers of every size. That makes co-worker harassment claims meaningfully easier to bring in New York than under Title VII, where the severe or pervasive standard still applies.

What to Do

Report in writing, so the date and content of the notice cannot later be disputed
Keep a copy of the report and any response outside company systems
Record each incident with dates, times, and witnesses
Note whether the employer separated you or the harasser
Track any change in your schedule, duties, or reviews after reporting

Conclusion

In co-worker cases the employer’s conduct after the complaint is usually the heart of the matter. A company that investigated properly and acted decisively may well have met its obligations. A company that minimised the report, moved you instead of the harasser, or had heard it all before generally has not.
