What Employers Need to Know About New Jersey's Worker Classification “ABC” Test Regulations

If your business relies on freelancers, gig workers, or 1099 contractors anywhere in New Jersey, a change is coming that you cannot afford to ignore. On May 5, 2026, the New Jersey Department of Labor and Workforce Development adopted a new set of regulations, codified at N.J.A.C. 12:11, that spell out for the first time how the state applies its longstanding "ABC test" for deciding whether a worker is an employee or an independent contractor. The rules become operative on October 1, 2026, which leaves employers a narrow window to review how they classify the people who work for them.

The ABC test itself is not new. It has been the statutory standard in New Jersey for roughly ninety years. What is new is that the state has now published a comprehensive framework explaining how it reads and enforces that test, drawing together decades of court decisions into one place. For any employer who has ever wondered where the line really falls between a contractor and an employee, this is the guidance that will shape audits, penalties, and litigation going forward.

Why Worker Classification Matters So Much in New Jersey

Getting classification wrong is expensive. The ABC test does not just govern unemployment insurance. It also controls coverage under the New Jersey Wage and Hour Law, the Wage Payment Law, the Earned Sick Leave Law, and the Temporary Disability Benefits Law. That means a single misclassification can expose a business to unpaid overtime, missed sick leave, back contributions, and significant civil penalties across several statutes at once.

New Jersey also starts from a position that favors employee status. Under state law, any service someone performs for pay is presumed to be employment. The burden is on the business, not the worker, to prove otherwise. If a company cannot carry that burden, the worker is treated as an employee.

The Three Prongs, Explained Simply

To treat a worker as an independent contractor, an employer must satisfy all three prongs of the ABC test. The test is conjunctive, which is a legal way of saying that failing even one prong ends the analysis and makes the worker an employee. Here is what each prong asks, in plain terms.

Prong A, Freedom from control. The worker must be free from the company's control or direction in how the work gets done, both under the written contract and in actual practice. Courts and the Department look at things like whether the worker sets their own hours, uses their own tools, and is free to take on other clients. Importantly, it is not enough to say a worker is independent on paper. If the company keeps the right to direct how the job is performed, this prong fails.

Prong B, Outside the usual business. The work must either fall outside the usual course of the company's business, or be performed away from all of the company's places of business. This is often the hardest prong to meet. If a worker is doing the very thing the company exists to do, a delivery driver for a delivery company, a stylist at a salon, the business will struggle here no matter how the relationship is labeled. One helpful clarification in the new rules: a worker's home does not automatically count as one of the employer's places of business, which matters in an era of remote work.

Prong C, An independent trade. The worker must be customarily engaged in an independently established trade, occupation, or business of their own, the kind of enterprise that would continue to exist even if the relationship with this particular company ended. A true independent contractor has their own business that stands on its own two feet.

What the New Rules Actually Change

The final regulations are best understood as explaining existing law rather than expanding it. They pull together key New Jersey Supreme Court rulings, including the 2022 decision in East Bay Drywall, LLC v. Department of Labor and the earlier landmark case Carpet Remnant Warehouse, Inc. v. New Jersey Department of Labor, and turn that case law into written guidance.

After a lengthy comment period that drew thousands of responses, the Department softened some of its original 2025 proposal. It removed a set of industry-specific examples that had alarmed the gig economy, media, and performing arts sectors, and it clarified that existing statutory exemptions still apply. But the core of the framework held firm. Two points in particular deserve an employer's attention. First, the business still carries the entire burden of proof. Second, a written contract calling someone an independent contractor is not the final word, especially where the company drafted the agreement on its own and the worker had no real ability to negotiate its terms. Substance beats labels.

What Employers Should Do Before October 1, 2026

The operative date gives businesses time to prepare, but not much. A few practical steps can reduce risk considerably:

Review every current independent contractor relationship against all three prongs, honestly, focusing on how the work actually happens rather than what the contract says. Keep detailed records that show how each contractor meets the test, because if a dispute arises, the company is the one that must prove it. Re-examine standard contractor agreements to make sure they do not quietly reserve rights that look like control. And pay close attention to anyone performing work that sits at the heart of what your business does, since Prong B tends to be where these relationships fall apart.
