The practical point is that it treats what happened to you as a violation of your civil rights rather than only as an injury. That framing carries through everything else about the claim, including who can be sued and what a court can award.

Where it applies

This is a New York City law, and it reaches conduct that occurred within New York City. That makes the location of the assault a threshold question rather than a detail, and it is one of the first things we ask about.

Location is not as simple as it sounds in every case. Some situations involve more than one place, and some involve travel, transport or a course of conduct rather than a single moment in a single building. What has to be shown

In broad terms, a claim under this law concerns an act of violence against a person that would amount to a crime, that presents a serious risk of physical injury, that was committed because of gender or on the basis of gender, and that caused you injury.

The element that draws the most argument is the gender element, which asks whether the violence was motivated at least in part by hostility based on gender. New York courts have often treated a sexual assault as reflecting that hostility in itself, on the reasoning that it cannot be separated from the absence of consent. That reading is not settled, and it is being litigated. Some courts have asked for allegations specific to the case rather than accepting the point as automatic, and the question is live in same-sex cases and in federal court in particular.

What this means for you is practical rather than theoretical. Where facts exist that speak to motive, such as what was said to you, what was said about you afterwards, or a pattern involving others, those facts are worth telling us even if they feel small. Who can be named

The person who committed the violence is the most direct defendant. The law has also been written to reach parties who direct, enable, participate in or conspire in gender-motivated violence, which is language aimed at organizations and individuals who made the violence possible rather than only at the person who carried it out.

That matters for a reason survivors are rarely told. An individual may have nothing worth recovering. An organization usually carries insurance, holds assets and generates records, and records are what turn a contested account into a provable case.

How far that reach extends depends heavily on when the conduct occurred, and the rules on that point have changed more than once in recent years and are being challenged now. What can be recovered

Two further categories set this claim apart. Punitive damages may be available, which are awarded to mark and deter conduct rather than to measure your loss. How long you may have

This claim carries a seven-year period, measured from the violence rather than from the point at which you understood its effect on you. That is considerably longer than the one-year period that applies to an ordinary claim against an attacker in New York, and it is the reason this route is often the only one left for a survivor whose assault was several years ago.

Additional time may be available in some circumstances, including where a survivor was unable to bring a case for reasons the law recognizes. Separately, New York City has at times opened limited windows allowing certain older claims to be brought. Rules of that kind can change, and some are currently being litigated, so a window that appears open may narrow or be challenged.

Do I need to prove the person hated women in general?

That is not how the question is usually framed. The law asks whether the violence was motivated at least in part by hostility based on gender, and courts have often treated a sexual assault as carrying that element in itself. Can I bring this claim if the criminal case went nowhere?
