Sexual Assault vs Sexual Harassment at Work: The Legal Distinction

Sexual assault and sexual harassment are often discussed together, but they are legally distinct. Understanding the difference matters both for how the case is framed and for which laws apply. In many workplace cases, the same set of facts gives rise to both types of claims, and pursuing them together typically produces the strongest result.

Sexual harassment

Sexual harassment is a form of employment discrimination under federal, New York, and New Jersey law. It includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature that meets one of two legal standards:

Quid pro quo: Employment decisions are tied to submission to sexual conduct.
Hostile work environment: Conduct is severe or pervasive enough to alter the terms and conditions of employment.

Harassment claims are typically brought under Title VII, the New York State Human Rights Law, the New York City Human Rights Law, or the New Jersey Law Against Discrimination, depending on the location and size of the employer.

Sexual assault

Sexual assault is a criminal offense involving non-consensual sexual contact. It ranges from unwanted touching to rape. In the civil context, it is a tort, meaning the survivor can sue the perpetrator directly for battery, intentional infliction of emotional distress, and related claims. When the assault occurs in a workplace context, the employer can also face liability under employment discrimination laws and other theories.

Where the two overlap

A single incident can be both sexual assault and sexual harassment. Unwanted physical contact from a supervisor is an assault, and if the conduct is severe enough, it also creates a hostile work environment. A pattern of harassment that culminates in an assault gives rise to both types of claims. Framing the case to capture both maximizes the available remedies.

Why the distinction matters

The distinction shapes what statutes apply, what deadlines control, and who can be sued.

Deadlines differ. Employment claims typically require an EEOC or state agency charge within a short window, sometimes as little as 180 or 300 days. Tort claims for the underlying assault carry different, and sometimes longer, deadlines.
Defendants differ. Employment claims are generally against the employer. Tort claims can name the individual perpetrator and, in appropriate circumstances, third parties.
Damages differ. Employment discrimination statutes cap certain damages at the federal level, though state and city laws often do not. Tort claims are not subject to those caps.

Building the strongest case

A well-constructed workplace sexual assault case typically includes both a harassment claim against the employer and a battery claim against the individual perpetrator, along with any applicable statutory claims.
