Sexual Jokes, Comments and Imagery at Work: When Words Become Harassment

Of all the forms of workplace sexual harassment, this is the one people most often talk themselves out of reporting. There is no physical contact and no explicit demand, and the response to any objection is almost always the same: it was only a joke.

Whether it was meant as a joke is not the legal test.

The Standard for Verbal and Visual Conduct

Because individual comments are usually less severe than physical acts, these claims typically depend on pervasiveness rather than severity. Occasional off-colour remarks generally will not meet the federal threshold. A steady stream of them over months frequently will.

That said, a single comment can be enough where it is sufficiently degrading, threatening, or humiliating, particularly coming from a supervisor.

New York Has Lowered the Bar Substantially

This is where jurisdiction matters most. Under the New York State Human Rights Law, harassment need only rise above petty slights and trivial inconveniences. Under the New York City Human Rights Law, the question is whether you were treated less well because of a protected characteristic.

Conduct that would be dismissed as insufficiently pervasive under Title VII can therefore support a viable claim in New York.

What This Conduct Looks Like

Sexual jokes, innuendo, or running gags in the office or in group chats
Comments about your body, clothing, weight, or attractiveness
Questions about your sex life, relationships, or dating history
Speculation or gossip about who you are sleeping with
Pornographic or sexualised images on screens, phones, walls, or shared drives
Explicit memes, GIFs, or links circulated on Slack, Teams, or WhatsApp
Screensavers, calendars, or posters with sexual content
Sexualised nicknames, or terms like sweetheart and honey used only for some staff
Graffiti or written material in shared spaces

It Does Not Have to Be Aimed at You

An important and frequently overlooked point: conduct you merely witness can contribute to a hostile work environment. Pornography displayed openly, a group chat full of explicit content, or colleagues routinely demeaning women in your hearing can support your claim even though nobody addressed a word to you.

The question is whether the working environment was hostile or abusive because of sex, not whether you were the individual target.

Digital Conduct Is Workplace Conduct

Much of this now happens on Slack, Teams, WhatsApp groups, and direct messages, including outside working hours. Employers sometimes argue that an unofficial group chat is private and beyond their responsibility. Where the group is made up of colleagues, formed through work, and affects the working relationship, that argument tends not to succeed.

The practical advantage is evidentiary. Digital harassment documents itself. Screenshot it, with timestamps and sender names visible, and store it somewhere you will retain access to.

The Joke Defense

Intent is not the test. Employers commonly respond that the person meant no harm, that everyone else found it funny, or that you are too sensitive. None of that is a legal answer. What matters is whether the conduct was unwelcome, whether it happened because of sex, and whether it was serious or persistent enough to alter your working conditions.

Nor does having laughed along at the time defeat a claim. People deflect to survive an uncomfortable workplace, and courts understand that.

Conclusion

Verbal and visual harassment is cumulative by nature, which makes a contemporaneous record more valuable here than anywhere else. If comments, jokes, or images have made your workplace one you dread walking into, that experience is capable of being a legal claim, particularly in New York.
